These Terms of Use define the relation between Scerri & Bonello Advocates (hereinafter referred to as the “Firm”) and visitors/users of www.sblaw.com.mt, including any pages and sub-pages thereof, (hereinafter referred to as the “Website”) as well as persons submitting data and/or information via this website.  We suggest users take the time to familiarise themselves with the contents of these Terms of Use, which may be amended from time to time.  Users, who do not agree to be legally bound by these terms, are kindly requested not to access this website. 

1. Applicability

  1. By using the Website, visitors agree to comply with and be legally bound by these Terms of Use;
  2. These Terms of Use shall take effect immediately on the first visit to the Website. 

2. Disclaimer

  1. The Website is intended solely for general information purposes;
  2. The material contained in this website is not intended to provide legal or other professional advice and visitors are advised to seek specialist advice on specific issues;

In accessing the Website, visitors agree that they may only download and store material for their own personal use.  Visitors are not permitted to copy, broadcast, download, store, transmit, show or play in public, adapt or change in any way the content of this website for any purpose without the prior written consent of Scerri & Bonello Advocates.

4. Privacy Policy

  1. Scerri & Bonello Advocates applies policies and practices with regard to Personal Data collected through the Website as defined in this clause 4.  These policies and practices are independent from the Firm’s offline personal data collection practices;
  2. In these Terms of Use, the term "Personal Data" refers to personally identifiable information about visitors/users, including names, birth dates, e-mail addresses or mailing addresses, and any other information that is identified with a visitor/user personally;
  3. Scerri & Bonello Advocates is committed to safeguarding privacy of visitors to the Website.  Visitors may provide the Firm with their Personal Data by using the Contact Form available on the Website or through the use of e-mail.  The only Personal Data Scerri & Bonello Advocates currently collects through the Website is the information that is voluntarily submitted by visitors to the site.  For example, visitors may use this site to contact Scerri & Bonello Advocates with questions and comments;
  4. Scerri & Bonello Advocates uses the Personal Data information which users submit to answer queries that would have been posted through the Website. Scerri & Bonello Advocates also uses this information to improve the content and functionality of the Website, to better understand its clients and markets, and to improve its services;
  5. Scerri & Bonello Advocates reserves the right to provide information about its services and related information to persons who submit their Personal Data to the Firm.
  6. Any processing of Personal Data collected from visitors will be carried out in accordance with the provisions of the Data Protection Act (Cap. 440 of the Laws of Malta) (hereinafter referred to as the “Act”).  Accordingly, Scerri & Bonello Advocates will store data that visitors provide and process it as may be necessary so that the Firm will be in a position to respond to any request that visitors may submit;
  7. Visits to the Website are monitored so that the Firm would identify the areas that are of particular interest to visitors and improve the site. The information that is collected in the process will not identify visitors. 
  8. Personal Data may be processed only if:
    1. the data subject has unambiguously given his consent; or
    2. processing is necessary for the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract; or
    3. processing is necessary for compliance with a legal obligation to which Scerri & Bonello Advocates is subject; or

    5. processing is necessary for the performance of an activity that is carried out in the public interest or in the exercise of official authority vested in Scerri & Bonello Advocates or in a third party to whom the data is disclosed; or
    6. processing is necessary for a purpose that concerns a legitimate interest of Scerri & Bonello Advocates or of such a third party to whom Personal Data is provided, except where such interest is overridden by the interest to protect the fundamental rights and freedoms of the data subject;
  9. Visits to the Website are monitored so that the Firm would identify the areas that are of particular interest to visitors and improve the site. The information that is collected in the process will not identify visitors.  For example, the Firm uses technology to track how many visitors access the Website, the date and time of their visit, the length of their stay, and which pages they view. The Firm also uses technology to determine which web browsers visitors use and the address from which they accesse the Website (for example, if they connected to the Website by clicking on a banner ad).  The use of this technology enables the Firm to compile statistics about visitors and their use of the Website. Scerri & Bonello Advocates uses this anonymous data and share it with third parties to improve the content and functionality of the Website, to better understand its clients and their needs, and to improve its services;
  10. Scerri & Bonello Advocates will provide information in response to any reasonable subject access request. Scerri & Bonello Advocates will ensure data are kept in an accessible form to facilitate subject access;
  11. Scerri & Bonello Advocates, at the request of the data subject shall provide to the data subject, without excessive delay and without expense, written information as to whether Personal Data concerning the data subject is processed:

Provided that a request by the data as aforesaid shall only be made by the data subject at reasonable intervals;

  1. Any such application shall be made in writing to Scerri & Bonello Advocates and is to be signed by the data subject.  If such data is processed, Scerri & Bonello Advocates shall provide to the data subject written information in an intelligible form about:
    1. actual information about the data subject which is processed;
    2. where this information has been collected;
    3. the purpose of the processing;
    4. to which recipients or categories of recipients the information is disclosed; and
    5. knowledge of the logic involved in any automatic processing of data concerning the data subject;
  2. Visitors who do not wish to receive information from Scerri & Bonello Advocates, or who may have any query on the processing of their Personal Data or who would like to have their Personal Data rectified, blocked or erased, are kindly requested to send an e-mail to: info@sblaw.com.mt
  3. Scerri & Bonello Advocates shall, at the request of the data subject, immediately rectify, block or erase such Personal Data that has not been processed in accordance with the Act or with regulations made thereunder;
  4. Scerri & Bonello Advocates shall notify any third party to whom the data has been disclosed about the measures undertaken as aforesaid:

Provided that no such notification need be provided if it is shown to be impossible or it will involve a disproportionate effort;

5. Use of E-mail

5.1 E-mail and any files or content transmitted with e-mails sent by Scerri & Bonello Advocates are confidential and intended solely for the use of the individual or entity to whom they are addressed;

5.2 Recipients who are not the named or intended addressees should not disseminate, distribute or copy such e-mail.  Such persons are kindly requested to notify the sender immediately by e-mail and delete such e-mail from their system.

5.3 Scerri & Bonello Advocates accept no liability for the content of e-mail sent from its systems, or for the consequences of omissions or any actions taken on the basis of the information provided, unless that information is subsequently confirmed in writing.

  1. The Website contains hyperlinks to websites that are not operated by Scerri & Bonello Advocates. These hyperlinks are provided for reference and convenience only and do not imply any endorsement of the activities of these third-party websites or any association with their operators;
  2. Scerri & Bonello Advocates does not control third-party websites and is not responsible for their data practices.  Users are advised to review the privacy policy posted on any site they visit before using the site or providing any Personal Data.

7. Amendments to these Terms of Use

Scerri & Bonello Advocates is continually improving and adding new functionality and features to the Website and improving and adding to existing products, services, and programs. Because of these ongoing changes, changes in the law, and the changing nature of technology, these Terms of Use, including the Firm’s policies and data practices as defined hereinabove, may change from time to time. If and when changes are made, Scerri & Bonello Advocates will post the changes on the Website to notify visitors/users of the changes.

8. Proper Law and Jurisdiction

  1. These Terms of Use shall be read and construed in accordance with Maltese Law;
  2. Any dispute arising in relation to the interpretation, construction of these Terms of Use or in connection with this website shall be subject to the exclusive jurisdiction of the Courts of Malta.
